Terms and Conditions of Charter

Welcome to Monferado Yacht Rentals. These Terms and Conditions ("Terms") govern your use of our yacht charter services and constitute a legally binding agreement between you ("Guest" or "Charterer") and Monferado Yacht Rentals ("Company," "we," "us," or "our").

1. Definitions

For the purposes of these Terms:

  • "Charter" refers to the rental of a yacht and associated services
  • "Vessel" refers to any yacht in our fleet
  • "Charter Period" refers to the agreed duration of the charter
  • "Base Port" refers to our marina location at Coal Harbour, Vancouver
  • "Captain" refers to the licensed professional operating the vessel

2. Booking and Reservations

2.1 Booking Process

All bookings must be made through our authorized representatives or official website. A booking is considered confirmed only upon receipt of the required deposit and our written confirmation.

2.2 Minimum Age

The primary charterer must be at least 21 years of age and provide valid government-issued identification.

2.3 Accuracy of Information

You agree to provide accurate and complete information during the booking process, including but not limited to guest count, special requirements, and contact details.

3. Payment Terms

3.1 Deposit

A non-refundable deposit of 50% of the total charter fee is required to secure your booking. The deposit must be paid within 48 hours of booking confirmation.

3.2 Final Payment

The remaining balance is due 14 days prior to the charter start date. Charters will not commence without full payment.

3.3 Additional Costs

The following costs are not included in the base charter fee and will be charged separately:

  • Fuel consumption
  • Food and beverages (unless specified in package)
  • Gratuities for crew
  • Damages beyond normal wear and tear
  • Extended cruising beyond agreed areas

4. Cancellation Policy

4.1 Guest Cancellation

  • More than 30 days: 50% refund of total charter fee
  • 15-30 days: 25% refund of total charter fee
  • Less than 15 days: No refund

4.2 Weather Cancellation

If weather conditions are deemed unsafe by our captain, the charter may be cancelled or rescheduled at no charge to the guest. We will make every effort to reschedule within a reasonable timeframe.

4.3 Company Cancellation

In the rare event we must cancel due to mechanical issues or other circumstances beyond our control, a full refund will be provided.

5. Charter Terms

5.1 Charter Duration

Charters begin and end at the times specified in your booking confirmation. Late arrivals will not extend the charter end time unless previously arranged and paid for.

5.2 Guest Capacity

Maximum guest capacity must not be exceeded under any circumstances. This limit is set by Transport Canada regulations and vessel safety requirements.

5.3 Operating Area

The vessel will operate within designated coastal waters as determined by the captain based on weather, safety, and regulatory considerations.

6. Guest Responsibilities

6.1 Conduct

Guests must conduct themselves in a respectful manner toward crew, other guests, and the marine environment. Disruptive behavior may result in charter termination without refund.

6.2 Safety Compliance

All guests must comply with safety briefings, wear provided safety equipment when required, and follow crew instructions at all times.

6.3 Prohibited Items

The following items are prohibited aboard our vessels:

  • Illegal substances
  • Excessive glass containers
  • Pets (unless pre-arranged)
  • Fireworks or flammable materials
  • Weapons of any kind

7. Safety and Insurance

7.1 Vessel Insurance

All vessels are fully insured for commercial charter operations in accordance with Canadian maritime law. This coverage protects the vessel and provides third-party liability coverage.

7.2 Guest Insurance

Guests are strongly advised to obtain their own travel and health insurance. Monferado is not responsible for personal property, medical expenses, or travel-related costs.

7.3 Safety Equipment

All vessels carry safety equipment exceeding Transport Canada requirements, including life jackets, emergency flares, first aid supplies, and communication equipment.

8. Liability and Indemnification

8.1 Limitation of Liability

To the maximum extent permitted by law, Monferado's liability is limited to the total amount paid for the charter. We are not liable for indirect, incidental, or consequential damages.

8.2 Guest Indemnification

Guests agree to indemnify and hold harmless Monferado, its employees, and agents from any claims, damages, or losses arising from:

  • Guest misconduct or negligence
  • Violation of these terms
  • Damage to the vessel beyond normal wear
  • Third-party claims resulting from guest actions

8.3 Assumption of Risk

Guests acknowledge that yacht charters involve inherent risks including but not limited to weather conditions, marine environment hazards, and mechanical failures. Guests voluntarily assume these risks.

9. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from acts beyond reasonable control, including but not limited to:

  • Natural disasters
  • Government actions or regulations
  • Labor disputes
  • Equipment failures
  • Pandemic or health emergencies

10. Governing Law

10.1 Jurisdiction

These Terms are governed by the laws of British Columbia, Canada, and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia.

10.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

10.3 Modifications

These Terms may only be modified in writing and signed by both parties. Monferado reserves the right to update these Terms with reasonable notice.

11. Environmental Responsibility

11.1 Marine Protection

Guests must comply with all environmental regulations and our company policies regarding marine protection, including proper waste disposal and wildlife interaction guidelines.

11.2 Damage to Marine Environment

Guests are liable for any environmental damage caused by their actions, including but not limited to pollution, wildlife harassment, or coral damage.

12. Privacy and Data Protection

Collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By booking with us, you consent to our data collection and use practices as described in our Privacy Policy.

13. Dispute Resolution

13.1 Mediation

Before initiating legal proceedings, parties agree to attempt resolution through mediation administered by the British Columbia International Commercial Arbitration Centre.

13.2 Arbitration

If mediation fails, disputes shall be resolved through binding arbitration in Vancouver, British Columbia, conducted in English.

14. Additional Terms

14.1 Photography and Media

Monferado may photograph or video record charters for promotional purposes. Guests who do not wish to be included must notify us in writing prior to charter commencement.

14.2 Communication

All official communications must be in writing and sent to the contact information provided in your booking confirmation.

14.3 Entire Agreement

These Terms, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements.
